 Minutes of the Monthly Meeting of the Board of Directors of
Westlake Homeowners Association
January 14, 2020; 6:30 p.m.; 15400 Boones Ferry Road, Lake Oswego


Board members in attendance:  Cynthia Gerwe, Fritz Gerwe, Chris Heuer, Rolland Royce
Others in attendance (for short-term rental discussion):  Jeff and Dory Becker, Carol Lawson, Robert Archie, Tom Over

Fritz called the meeting to order at 6:30 p.m.

Meeting minutes
.  Chris previously circulated the minutes of the December monthly Board meeting.  The minutes were approved as presented.  

Short-term rental discussion.  Homeowners in attendance related that a home on Coventry Court recently has been converted to use as a short-term rental.  The neighbors understand that the homeowner has moved to Vancouver, Washington.  The home is listed for rent on the Vrbo website, but is not registered with the City of Lake Oswego for short-term rental use.  Because the property is not the homeowner’s primary residence, the use does not comply with the city’s requirements for short-term rentals.  The home was rented over a recent weekend and the renters partied loudly and late into the night.  The persons occupying the house for the weekend came in several cars that filled the surrounding street.  The homeowner in this instance also has failed to maintain the landscaping and fence in an acceptable fashion since moving into the neighborhood two years ago, despite several requests from the Association.

The Board noted that the use of the Coventry Court home violates the prohibition on noxious or offensive activities provision of Article IX of the Association’s Declaration of Covenants and Restrictions (CC&Rs) and may also violate the prohibition on commercial uses of the Association’s community guidelines.  The Board agreed it would contact the City and Vrbo to obtain additional information regarding noncompliance with their rules.  The Board encouraged neighbors to contact the Lake Oswego Police and the Clackamas County Sheriff’s office to report disturbances, including late night noise.

After the other attendees left the meeting, the Board discussed the detrimental effects short-term rentals have on nearby neighbors and on the character of the Association’s community as a whole.  The Boars then adopted the following rule in accordance with Article IX of the CC&Rs and Section 7.2 of the Bylaws:

No Owner or Unit Owner shall use or offer any lot or improvement within the Association as a short-term rental (rentals of less than 31 days).

The Board agreed to send letter to the homeowner notifying the homeowner that he is in violation of Association rules and demanding that he immediately terminate all prohibited uses of the property, including as a short-term rental and as a site of offensive activities.  The letter also will demand that the homeowner take actions to bring the yard and fence into compliance with Association rules.

Treasurer’s report.  Rolland reviewed the December 2019 financials.

Open space and common area maintenance.  Cynthia reminded the Board of the need to address the condition of trees on Parkview that may encroach into one or more yards on Greensborough Court and bushes on a property on Amberwood Circle that block the view of cars approaching from either direction.

.   The Board confirmed and set the following upcoming monthly meetings, to be held at Hasson Company Realtors, 15400 Boones Ferry Road, Lake Oswego:

Monday, February 10, 2020, 6:30 p.m. (mailing of notices of annual meeting and related proxies)
Monday, March 16, 2020, 6:30 p.m. (annual meeting of homeowners)
