 Minutes of the Monthly Meeting of the Board of Directors of
Westlake Homeowners Association
January 23, 2023 at 6:30 p.m. - by phone


Board members in attendance:  Chris Heuer, Bill Scharwatt, and Rolland Royce.  Fritz Gerwe and Lev Volod were absent.

Minutes of the December 12, 2022 board meeting – approved.  

Treasurer’s report.  Rolland reviewed the 2022 financial statements, including current month, year-to-date, budget variances, cash disbursements ledger, water billing detail, and the listing of homes sold in 2022.  The board approved a transfer of $20,000 from the operating account to reserves.  An invoice for $480 from Vial Fotheringham for counsel on the new past due account policy was approved.  Approximately 200 homeowners have paid 2023 dues, similar to the collection rate in 2022.  A draft of the 2023 Budget was presented – after discussion the board agreed to finalize at the February meeting.  Rolland will forward financial statement information to Schwindt and Co. for preparation of the 2022 tax returns.

Architectural Design Review Committee and common area maintenance.    
A request for a tree removal on Hastings Ct – approved
A request for fence with height variance on Amberwood Circle – approved
A request for outdoor patio structure – approved with agreed changes
A request for tree removal on Hastings Ct – approved

Other.

Structure discussed at prior board meetings – the homeowner has agreed to modifications suggested by the board.  The separate requested variance in fence height was approved as modified by the neighboring homeowner.

Walking path on Kruse Way between Camden and Westlake – tree root issues.  As this is City property, Fritz will contact the appropriate City department.  

Asphalt path on Westlake Drive north of Amberwood Circle – Green Growth has been selected to remove the overhanging plants and branches.  Bill met with S-2 Contractors who will repave the path as agreed, with proper drainage included.  Project will begin after tree trimming phase is complete.  

Tree removal requests – the board discussed updating our policy based upon HOA CCRs and City of LO guidelines.  Rolland will draft a policy accordingly for discussion at the February meeting.  

Homeowner inquiry on solar panel installation – the board affirmed its position that while solar panels are allowed by state law, such installations do not fit with the stated HOA bylaws and guidelines, and therefore are discouraged.  

Pickleball courts at Westlake Park – the board discussed the impact that these courts would have on sound levels in our neighborhood, and agreed to study the communications from the Neighborhood Association further.

Issues raised at the March 2022 annual meeting:  
Street parking, including nose-in parking in cul-de-sacs
Crossing protection at the two intersections of Westlake Dr. and Amberwood Circle
 
Reserve study:  Rolland will coordinate an update of this required study by March 31, 2023.
